K&N alleges that Spectre’s HP and CFM ratings are false, misleading, or deceptive, and that these claims constitute violations of the Lanham Act (15 U.S.C. 1125) and California law (California Business and Professional Code 17200 et seq.). The Court has jurisdiction to hear these claims under federal question jurisdiction, 28 U.S.C. 1331 and 1338(a), and under state unfair competition law, Cal. Bus. & Prof. Code SS 17500 et seq.

For its HP and CFM ratings, Spectre used projected air flow rates derived from airflow testing on its filters at a pressure drop of 20.4″ of water, which is far greater than the normal air flow restriction experienced in a vehicle’s engine in operation. Additionally, Spectre did not disclose the actual airflow restrictions of its air intake systems or the specific horsepower and torque that would be generated by a vehicle equipped with one of these systems. Moreover, Spectre’s dyno test data did not show that its air intake systems could actually achieve the alleged horsepower and CFM ratings.
